Construction Joint Stock Company 47 (C47) discloses information that on September 11, 2026, the Company received Decision No. 105/2026/QĐ-PQTT dated August 18, 2026 of the Ho Chi Minh City People’s Court on setting aside the arbitral award relating to the dispute between Da Nhim – Ham Thuan – Da Mi Hydropower Joint Stock Company and Construction Joint Stock Company 47.

Content of the information disclosure
Pursuant to Decision No. 105/2026/QĐ-PQTT dated August 18, 2026, the Ho Chi Minh City People’s Court decided:
- To reject the request of Da Nhim – Ham Thuan – Da Mi Hydropower Joint Stock Company to set aside the arbitral award for dispute No. 254/24 HCM dated November 23, 2025 of the Vietnam International Arbitration Centre at the Vietnam Chamber of Commerce and Industry (VIAC) – Ho Chi Minh City Branch.
- Da Nhim – Ham Thuan – Da Mi Hydropower Joint Stock Company shall not bear the fee.
- This Decision is a final decision and takes legal effect from the date of signing, i.e. August 18, 2026. The parties and the Arbitral Tribunal have no right to complain or appeal; the Procuracy has no right to protest.
Background of the case
The dispute arose from Contract No. 368 between Da Nhim – Ham Thuan – Da Mi Hydropower Joint Stock Company (the investor) and Construction Joint Stock Company 47 (the contractor) at the Da Nhim Hydropower Plant Expansion Project.
Da Nhim – Ham Thuan – Da Mi Hydropower Joint Stock Company filed a lawsuit at VIAC, and the Arbitral Tribunal issued the arbitral award for dispute No. 254/24 HCM dated November 23, 2025. Subsequently, the investor submitted a request to the Ho Chi Minh City People’s Court to set aside this arbitral award.
With Decision No. 105/2026/QĐ-PQTT dated August 18, 2026, the Ho Chi Minh City People’s Court did not accept the request to set aside the arbitral award; accordingly, arbitral award No. 254/24 HCM remains in effect.
